General Terms and Conditions and Purchase Conditions

  1. General provisions

1.1 These terms and conditions of the online shop apply to all legal relations arising between all persons (hereinafter: Buyer) and the owner Bangalo Grupp OÜ, registry code 4388901, of the online shop at https://nordic-bungalow.eu (hereinafter: Nordic-Bungalow’s online shop) related to the purchase of products in Nordic-Bungalow’s online shop.

1.2 In addition to these terms and conditions, the legal relations arising from the purchase of products in Nordic-Bungalow’s online shop are regulated by the legislation of the Republic of Estonia.

1.3 Bangalo Grupp OÜ has the right to change and update these terms and conditions and the pricelist based on developments in Nordic-Bungalow’s online shop and for the purpose of the better and safer use of the online shop. Notification of changes and updates in the pricelist will be made through Nordic-Bungalow’s online shop. Any changes and updates in the terms and conditions and the pricelist become effective after publication thereof in Nordic-Bungalow’s online shop. If the Buyer has placed an order before the changes became effective, the legal relationship between the Buyer and Bangalo Grupp OÜ will be subject to the terms and conditions valid at the moment the order was placed by the Buyer, except when provided otherwise in the legislation or these terms and conditions.

  1. Prices

2.1 All prices in Nordic-Bungalow’s online shop are given in British pound sterling and include a value added tax of 20%.

2.2 The prices indicated in Nordic-Bungalow’s online shop are valid until the due payment of the invoice.

2.3 The delivery charge is not included in the price and will be paid by the Buyer. The delivery charge depends on the Buyer’s location and the method of delivery. The delivery charge is displayed for the Buyer during checkout. More information about delivery times and transport is available in Nordic-Bungalow’s online shop.

2.4 Bangalo Grupp OÜ has the right to change the prices in its online shop at any time. If prices in Nordic-Bungalow’s online shop change after the Buyer has placed an order and paid for it, Bangalo Grupp OÜ must deliver the products to the Buyer at the prices that were valid during placement of the order. The Buyer does not have the right to demand compensation for the price difference.

  1. Order checkout

3.1 The shopping cart is created when you click on the link “Add to cart”.

3.2 Enter the required data on the checkout page. Select method of delivery and click “Next”.

3.3 Select the method of payment, read the Terms and Conditions and check the box “Accept Terms and Conditions”.

3.4 Check your order and click “Place order”.

3.5 Be careful when filling in the details of the person placing the order as the accuracy and correctness of these details ensures the timely and trouble-free fulfilment of your order.

3.1 Bangalo Grupp OÜ will e-mail the order confirmation to you along with the best estimate of the delivery time. If you accept the terms and the delivery time, we will issue you an invoice. More information about delivery time and transport is available in Nordic-Bungalow’s online shop.

3.3 The sales contract for the products is deemed to be entered into (effective) after the deposit of the amount payable based on the order confirmation in the bank account of Bangalo Grupp OÜ.

3.4 The orders placed in Nordic-Bungalow’s online shop are processed on business days (Mon-Fri from 9 a.m. to 5 p.m.). If an order is placed later than 4 p.m. on the last business day of the week, the order will be processed on the next business day.

  1. Withdrawal from contract

4.1 Product images are for illustration purposes only.

4.2 Bangalo Grupp OÜ retains the right to adjust the prices of products. In these cases, Bangalo Grupp OÜ retains the right to withdraw from the sale and refund the paid amount to the Buyer’s bank account in 10 business days.

4.3 Bangalo Grupp OÜ retains the right to withdraw from the sales if any of the following problems occur with a product: a human error in entering the price or a technical error in the system (e.g. if a product that costs £3,000 is sold in Nordic-Bungalow’s online shop for £300, this is obviously a mistake. Therefore, we expect the Buyer to realise it is a mistake and that the product will not be sold for this price.)

4.4 Product information is regularly reviewed and updated. The data may have been updated after your last visit.

4.5 If the Buyer wishes to withdraw from the contract after placing an order and before the execution of the order by Bangalo Grupp OÜ, the Buyer must notify Bangalo Grupp OÜ thereof at the earliest opportunity. The withdrawal form is available in Nordic-Bungalow’s online shop. The Buyer may also send a written notice to the e-mail info@nordic-bungalow.eu. In the e-mail, please supply the following information:

  • Buyer’s name and contact details
  • Date of purchase
  • The number of the order or invoice to be withdrawn from

4.6 If Bangalo Grupp OÜ receives the withdrawal form after the performance of the contract by Bangalo Grupp OÜ, the “Return policy” provision in the General Terms and Conditions will apply.

4.7 Withdrawal from the contract free of charge applies to the purchase of standard products. If it is a special-order product, once the order has been paid for, Bangalo Grupp OÜ will have the right to charge the Buyer a service handling fee in an amount totalling up to 30% of the cost of the ordered product and to withhold it from the amount to be refunded to the Buyer.

4.8 Bangalo Grupp OÜ will refund the paid amount to the Buyer without delay, but not later than within 10 business days after the receipt of the notice of withdrawal.

4.9 The amount will be refunded to the bank account from which the Buyer transferred the payment to Bangalo Grupp OÜ.

  1. Return policy

5.1 The contracts signed in Nordic-Bungalow’s online shop are subject to a 14-day right of withdrawal, i.e. the withdrawal form must be submitted to Bangalo Grupp OÜ in written reproducible format within 14 days of the delivery of the product to the Buyer. If the Buyer decides to withdraw from the contract, the Buyer is obliged to return the ordered products to Bangalo Grupp OÜ.

5.2 If the returned product is not defective, is complete, unused and in the unopened original packaging, 100% of the cost of the product can be refunded to the Buyer.

5.3 If the returned product is defective, the Buyer will be held liable for the loss in value of the product. For example, if a house has been erected this means that many elements have been fixed with nails or screws, and therefore these elements and fixing devices cannot be reused. The same applies to any elements that have been processed, e.g. if the elements have been painted.

5.4 To return a product, a return delivery note must be sent to info@nordic-bungalow.eu.
The note must contain the following information:

  • Buyer’s name and contact details
  • Date of purchase
  • Purchase document (invoice) number
  • House pack number (on the package or installation instructions)

The return delivery note can be submitted through Nordic-Bungalow’s online shop; the form is also available in the online shop.

5.5 Upon withdrawing from the contract and returning a product, the Buyer must return the purchased product without delay, within 14 days at the latest after notification of the withdrawal.

5.6 The Buyer must pay the costs of returning the product, except if the products to be returned do not comply with the Buyer’s order.

5.7 If the Buyer returns a product, the money will be refunded without delay, within 14 days at the latest after the receipt of the withdrawal notice. Bangalo Grupp OÜ has the right to withhold the refund until the Buyer returns the product(s) or presents proof of having returned the product back.

5.8 The amount will be refunded to the bank account from which the Buyer transferred the payment to Bangalo Grupp OÜ.

5.9 If after the product is returned it becomes clear that the product does not meet the requirements provided in clauses 5.2 and 5.3 of the Contract, the Buyer will not receive a refund and Bangalo Grupp OÜ will store the returned product. The Buyer will bear the costs related to storing or returning the product to the Buyer.

5.10 The 14-day right of withdrawal will not apply in the case of any special-order product that has been customised to suit to the personal needs of the Buyer or the requirements provided by the Buyer.

  1. Personal data processing

6.1 The Buyer gives Bangalo Grupp OÜ his/her clear and informed consent to process his/her personal data.

6.2 Nordic-Bungalow’s online shop will only use the personal data entered by the Buyer (incl. first name, family name, phone number, address, e-mail address, bank details) for processing the order and sending the ordered product to the Buyer. Among other things, the Buyer gives Bangalo Grupp OÜ consent to send an order confirmation to the e-mail address provided when placing an order.

6.3 All of the Buyer’s personal data that have become known during the purchases in Nordic-Bungalow’s online shop will betreated as confidential information. An encrypted channel for bank transactions ensures the security of the Buyer’s personal data and bank details. Bangalo Grupp OÜ has no access to this data.

6.4 When bank card details are requested, secure SSL data communication is used, which complies with PCI DSS requirements.

6.5 Personal data are processed byBangalo Grupp OÜ, registry code 14388901, Põhja 21c, 10414 Tallinn, Estonia

6.6 Bangalo Grupp OÜ will not transfer the Buyer’s personal data to any unauthorised persons.

6.7 Nordic-Bungalow’s online shop will forward the Buyer’s personal data (first name, family name, phone number and address) to the logistics company so that the ordered products can be delivered.

6.8 The Buyer has the right to access his/her personal data at any time and request that the data be rectified, removed or deleted, except when provided otherwise by law.

  1. Intellectual property

7.1 The photos, texts and other works in Nordic-Bungalow’s online shop are copyrighted by Bangalo Grupp OÜ or its cooperation partners.

7.2 The website of Nordic-Bungalow online shop may contain references or links to third party websites. Bangalo Grupp OÜ will not assume responsibility for the content of or services provided on such websites.

  1. Procedure for claims

8.1 Bangalo Grupp OÜ will not assume responsibility for any defects in products caused by improper or abnormal installation, use and/or maintenance of the product.

8.2 According to the Law of Obligations Act, Bangalo Grupp OÜ is responsible for any defects and non-compliances in the products for 5 years. During the first six months after delivery of the product to the Buyer, the defect is assumed to have been there at the time the product was delivered. Bangalo Grupp OÜ is obliged to disprove this assumption.

8.3 Should any defects or non-compliances appear in the product the Buyer must notify Bangalo Grupp OÜ thereof within two months at the latest by filing a claim.

8.4 If the Buyer has any claims related to the ordering of products or making purchases from Nordic-Bungalow’s online shop or any defects or non-compliances, the claims should be sent to info@nordic-bungalow.euor notification be made by calling. The claim form can also be filed through Nordic-Bungalow’s online shop and the form is available in the online shop.

8.5 The following information must be included in the claim form:

  • Buyer’s name and contact details
  • Date of the occurrence and the claim
  • The defect in the product or service
  • The complaint filed by the Buyer to Bangalo Grupp OÜ (resolution sought by the Buyer)
  • Order details (order number or invoice number)
  • House packing number (on the package or on the installation instructions)

8.6 If a claim is filed during the first six months after delivery of the product to the Buyer, Bangalo Grupp OÜ will bear the costs related to the repair or replacement of the product, including transport, postage, labour, travel and material costs, except in the case of the defects described in clause 8.1 of the Terms and Conditions.

8.7 In case of a defective product, the Buyer has the right to request that the product be repaired or replaced. If it is impossible for Bangalo Grupp OÜ to repair or replace the product or the repairs or replacement cannot be carried out within a reasonable amount of time, the Buyer has the right to request that the purchase price be refunded.

8.10 If the Buyer requests that a defective product be repaired and Bangalo Grupp OÜ fails to do this within a reasonable amount of time, the Buyer may not repair the product or order its repair and thereafter demand that Bangalo Grupp OÜ compensate the incurred expenses.

8.11 All claims are reviewed, and the Buyer is contacted as soon as possible, but within 14 days after receipt of the claim at the latest.

  1. Liability and force majeure

9.1 Bangalo Grupp OÜ assumes liability for any damages caused to the Buyer and the Buyer assumes liability for any damages caused to Bangalo Grupp OÜ caused by a breach of these terms and conditions in the cases and to the extent prescribed by the legislation of the Republic of Estonia.

9.2 Bangalo Grupp OÜ is not liable for any damages caused to the Buyer or any delays in the delivery of the product if such damage or delay is caused by events which Bangalo Grupp OÜ could not have affected and did not, or could not have, foreseen (force majeure).

  1. Settlement of disputes

10.1 Any disputes between the Buyer and Bangalo Grupp OÜ will be resolved by negotiation.

10.1 In any issues not regulated by these terms and conditions, the legislation of the Republic of Estonia will apply.

10.2 If the Buyer and Bangalo Grupp OÜ fail to reach an agreement, the Buyer has the right to turn to the UK European Consumer Centre.
